Matrimonial Finance

The matrimonial finance team comprises 14 members and is led by Nick Sproull.

Our clerks are Michael Harding, Julie Hathway and Marcus Harding, each of whom has many years of clerking experience. They will be happy to recommend the most suitable member of the team for each case.

The team is widely regarded as the strongest on the Western Circuit and is always ranked in the top band by both the Legal 500 and Chambers and Partners. The 2021 edition of Chambers and Partners described the team as:

pre-eminent…the barristers at the set are frequently called upon to act for high net worth individuals in complex financial remedy disputes often involving family busineeses, pre-matrimonial and foreign assets, and TOLATA cases.”

Chambers and Partners 2021 ranks Charles Hyde QC as one of the two band one silks on the Western Circuit, and Deborah Dinan-Hayward, Nick Sproull and Dan Leafe as three of the seven band one juniors.

The team handles the division of finances arising from marital and partnership breakdown in all its forms, including on divorce, dissolution of civil partnerships, applications under Schedule 1 of the Children Act 1989 and applications under TOLATA 1996. Members regularly assist in the drafting of pre-nuptial agreements.

Our members operate at all levels, from our junior members who handle the smaller money cases, where issues usually focus upon meeting the needs of the parties and their children; all the way up to our senior practitioners, who deal with multi-million pound cases on a daily basis.

Many of our cases involve the instruction of experts to report as to the value of properties, pensions and tax, as well as all matters relating to small businesses, including the nature and value of shareholdings, liquidity, maintainable earnings and tax. Our members work with some of the leading experts in the field, both as single joint experts and shadow experts.

We also deal with cases where some of the assets have been inherited or gifted by family members; with cases where assets have been dissipated and an injunction is required; with cases involving assets which are abroad; and with cases where assets are held within a family trust.

Our team practises throughout the South West and beyond, and travel or appear remotely in all parts of England and Wales. Our members are well-known to local judges and the senior judiciary. Three members of the team sit in a part-time judicial capacity.

We recognise that the court process can sometimes be cumbersome and expensive and that many cases are better resolved through Alternative Dispute Resolution, whether mediation, arbitration or Private FDR. Many of our team appear as advocates in ADR and each of our senior practitioners is available to sit as the Judge in PFDRs, whether in Chambers or elsewhere. An article can be found here.
