Simon Emslie specialises in employment law.

Employment:
Simon acts for claimants and respondents in a variety of areas, including unfair and wrongful dismissal, breach of contract, all forms of discrimination and cases involving redundancy. He has appeared in Employment Tribunals across the country.

Recent employment cases of interest:
Roberts v Governing Body of Whitecross School (2011) – case turned on the interpretation of paragraph 9.1 of Section 4 of the Burgundy Book;

M v G (2011) – claim for disability discrimination, harassment and victimization;

Senior v Regents Theological College (2011) – claim for direct religious discrimination;

Lynn v Royal Cornwall Hospitals NHS Trust (2011) – claim for constructive unfair dismissal;

K v V Ltd (2010) – claim for unfair dismissal where the Claimant was dismissed on grounds of gross misconduct for an alleged sexual assault;
Krishnasamy v Yusufs Company Ltd (2010) – claim for unlawful deduction from wages and indirect racial discrimination.

Civil:
Simon also frequently undertakes various civil matters, particularly those involving contractual disputes and personal injuries. He drafts pleadings and advises at all stages of proceedings and has experience of representing clients at mediation.

Recent civil cases of interest:
Portishead Pool Community Trust v Griffith and Barnett (2011) – injunction under the Protection from Harassment Act 1997;

Kings Barton Housing Association Ltd v Ward (2011) – claim for possession;
Barnes v Swindon B.C. (2011) – claim for disability discrimination in relation to the Defendant’s car parks;

I Ltd v PTS Ltd (2011) – case in which it was argued that the claim had not been properly authorised in the Claimant’s name;

Sturman v Burns & Ocean Adventures (2010) – personal injury case heard in the Admiralty Court;

S v CPS (2010) – acted for the CPS where the defendant in Crown Court proceedings applied to the County Court for an injunction under the Human Rights Act 1998.

Crime:
Simon undertakes defence and is a CPS panel advocate level 1 prosecutor in the Magistrates’ and Crown Courts.

Cases of interest:
R v Underwood (2010) – Represented defendant in relation to the Crown’s application for a Serious Crime Prevention Order, following a million pound national conspiracy to burgle;

R v Witter (2009) – Led junior in six-week multi-handed trial for conspiracy to supply cocaine.
