Kirsty Real is an experienced advocate and a specialist in Criminal Law undertaking prosecution and defence work. She is a CPS grade 3 prosecutor.
She is regularly instructed in relation to serious assaults, violence, and public order offences, dishonesty, drugs, and sexual offences.
Kirsty has significant experience of frauds and financial offences, ranging from credit card and internet fraud, ‘teeming and lading’, voiding cash transactions, through to social security and immigration benefit fraud. She has considerable experience in relation to the Proceeds of Crime Act, both confiscation following criminal proceedings, and forfeiture of detained cash.
She has a particular interest in cases which involve mental health issues, whether this be fitness to plead, insanity/ automatism defences, or seeking an appropriate solution in relation to charges or sentence.
Kirsty has significant expertise in relation to matters of Public Interest Immunity, disclosure and confidentiality. She is regularly instructed by social services and health departments to vet their files, and to advise on their protocols with other agencies.
She receives regular instructions in relation to Parole Board hearings.
She acts frequently for local authorities in cases involving regulatory offences including trading standards and health and safety matters.
Mental Health
Kirsty deals with civil detention cases as well as those where the patient has been made the subject of a Hospital Order or Restriction Order by the criminal courts. She also has considerable experience in acting for local authorities in applications to displace Nearest Relatives.
Inquests
Kirsty represents the police, families and other interested persons in Coroner’s courts, in particular in relation to road traffic accidents, suicide and cases involving drink and drugs.

R v Crook [2007] EWCA Crim 378 – Defence appeal against conviction to Court of Appeal involving argument over the presumption against consent in rape under section 75 Sexual Offences Act 2003.
Cases of Interest
R v Youds and others: Junior counsel in defence of care home manager in multi-defendant case in which it was alleged that elderly patients had been neglected;
R v Sheppard and Others: Junior counsel in a prosecution of multiple defendants in a series of trials and confiscation proceedings involving theft, fraud and money laundering;
R v Collins: Defence of dangerous driving where defendant suffered epileptic seizure: involved issues of insanity/automatism;
R v Castle: Defence of dangerous driving where Defendant suffered Hypoglaecemic diabetic episode.
