Defending in Regulatory crime
Against the backdrop of an increasing number of prosecutions by various Regulatory agencies, the Albion Chambers Regulatory team, headed by Jason Taylor, recently presented a seminar which was designed to equip those practitioners who defend such cases.
Encompassing HSE, Environmental and Trading Standards prosecutions, the seminar set out strategies to overcome the obstacles and difficulties that defendants face at each stage of the trial process; topics included investigatory powers, defective indictments, voluntary interviews, abuse of process, reverse burden of proof, the vexed question of reasonable foresight and material risk and sentencing guidelines.
