Practice:
A matrimonial finance and probate specialist, Deborah Dinan-Hayward undertakes privately-funded cases in this field. She is the leader of Chambers’ Family Team. Her areas of expertise include:

  • matrimonial finance on divorce with particular expertise in high net-worth * ancillary relief cases;
  • Cohabitation and property ownership disputes;
  • applications brought under the Trusts of Land and Appointment of Trustees Act 1996, including claims based on proprietary estoppel and constructive trusts;
  • applications under the Inheritance (Provision for Family and Dependants) Act 1975;
  • contentious and non-contentious probate matters including the upholding or challenging of wills, claims regarding the removal of executors and trustees and the variation of dispositions on death, and issues regarding testamentary capacity, want of
  • knowledge and approval of the terms of the will and undue influence;
  • claims involving the intervention of a third party;
  • financial applications in relation to children.

Deborah has a special interest in the financial aspects of Brussels II revised and international disputes in matrimonial finance provisions.

Deborah’s practice encompasses professional negligence claims within her area of expertise and aspects of insolvency within matrimonial finance disputes.

Although most of Deborah’s work is undertaken in the County Court and High Court she is happy to represent clients at arbitrations, mediations or other forms of ADR”.
